The Election for Democracy Association (Perludem) has welcomed the Constitutional Court’s (MK) ruling requiring political parties to ensure that at least 30 per cent of their candidates for legislative office in each constituency are women.

Perludem researcher Haykal said the Constitutional Court’s ruling aligns with the hopes and advocacy of civil society, which had been championed since the 2024 general election. In his view, this ruling provides clearer legal certainty regarding the fulfilment of the women’s quota in elections.

Haykal explained that the Constitutional Court not only reaffirmed the obligation regarding women’s representation but also imposed clear sanctions on political parties that fail to meet it. Under the ruling, political parties that fail to meet the minimum 30 per cent quota for female candidates may be disqualified or excluded from the relevant electoral district.

In addition to providing legal certainty, this ruling is also seen as narrowing the scope for differing interpretations regarding the women’s quota rule, which has long been a source of controversy in the conduct of elections. Perludem considers that the Constitutional Court’s ruling simultaneously reinforces the regulations previously addressed by a Supreme Court ruling concerning the issue of women’s representation in the 2024 general election.

The ruling was read out by the Chief Justice of the Constitutional Court, Suhartoyo, in Case No. 128/PUU-XXIV/2026. The Constitutional Court declared that Article 245 of Law No. 7 of 2017 on Elections is inconsistent with the 1945 Constitution insofar as it is not interpreted to mean that the General Elections Commission (KPU) is obliged to disqualify political parties that do not meet the requirement of at least 30 per cent female representation.

In his legal reasoning, Constitutional Court Justice Adies Kadir emphasised that the clarification of this rule is necessary to realise the principle of popular sovereignty in fair elections. In his view, strict sanctions are important to reduce discrimination against women’s representation in the House of Representatives (DPR) and Regional People’s Representative Councils (DPRD), as well as to encourage more equal political participation by women.
