The Association for Elections and Democracy (Perludem) has urged the House of Representatives and the government to immediately begin formal discussions on the Election Bill, which, despite being included in the priority legislative programme, has so far shown no clear progress.
Perludem’s Executive Director, Heroik Mutaqin Pratama, believes that discussions on revising the Election Law must not merely be political rhetoric without an open and definitive legislative process. He notes that civil society has prepared proposals for the codification of the Election Law, yet to date there is no official draft nor any certainty regarding the mechanism for discussion within the DPR.
Perludem is concerned that the revision may once again be carried out too close to the election stages, as has been the case in the past. This situation is seen as potentially disrupting the organisers’ preparations and limiting public participation in the process of drafting election regulations.
Furthermore, Perludem has also highlighted the increasing number of constitutional challenges to the Election Law being brought before the Constitutional Court in the run-up to the 2024 elections, which could potentially affect legal certainty once the election stages are already underway.
In the revision of the Election Law, Perludem believes there are three key issues that need to be addressed immediately: the design of the electoral system, including the parliamentary threshold; the institutional restructuring of the KPU and Bawaslu; and the management of the electoral process and the enforcement of electoral law.
Perludem has also called on the House of Representatives and the government to immediately establish a mechanism for discussing the draft Election Law in an open and participatory manner, as the timeframe leading up to the election is considered to be growing increasingly tight.
